Mediation - How to Get Started - Our Process
-
Our process begins with a separate telephone consultation with each party and/or representative. We actively listen to each side to gain an understanding of the issues.
-
Once we have completed this preliminary step, we encourage the parties to submit written briefs or summaries outlining their positions, including any supporting documents.
-
We analytically evaluate all information provided using our diverse combination of legal skills.
-
Once our initial analysis is complete, we contact each side separately to further focus the issues. We then find an agreeable date to schedule the mediation.
Thinking Inside, Outside & Around The Box
Our out-of-the-box thinking and dynamic chemistry benefit our clients, providing a flexible approach to the mediation process.
Prior to the mediation date, we determine where the problems lie and the parameters of our clients’ involvement. These initial parameters serve as the client’s “box” – for example, their workplace, contract to which they are parties, neighborhood in which they live, etc. We study details inside, outside, and around the “box” to gain a full understanding of the situation. Sometimes the answer is simple and can be found by looking directly inside the “box.” In these cases, original purposes or goals are identified quickly and resolution can be swift.
More often, however, the answer is not that simple. That is when we get creative.
We look beyond the scope of the “box” and work closely with our clients and their representatives to think around and beyond the four corners. Our techniques encourage our clients to think in novel ways, helping them work past prior obstacles and through any self-imposed limitations created by entrenched positions or paralyzing emotions. In these situations, with our assistance, clients realize the power of negotiation. Their direct involvement in the resolution process helps them shift their mindset beyond what “was” to what “can be.”
With the parties, we work towards creating a workable and realistic agreement, tailored just for them. This process moves everyone in a future-focused direction, with the intent of all parties leaving feeling heard, fulfilled, and able to put their disputes behind them. It is what has made Sanfilippo & Haddad’s mediations effective.
